1 hr. 3.25 Minute mark KATIE WORTHINGTON – PROPERTY OPINION
This meeting involves the county right to access gravel on an abandoned rail line that runs across northern Preble County. My understanding from this audio is that one gentleman put in a concrete driveway and like most everyone else ran that to the road across the right-of-way. County trucks or equipment have apparently damaged that driveway accessing what is mentioned as several more years of gravel. The decision is that while the county commission may feel bad for the damage but the easement allows them access. I am not familiar with the details of this case but there have been successful legal cases challenging the county owner ship of that railroad right of way. The last I knew the county had lost 3 cases on the issue with a couple more challenges possible.
Property in Verona.
Involves gravel on and rail road right of way.
