Day on NO Need For Shawnda Without Goose Creek – 2-1 Vote for Land Use Management Director – Goose Creek not Worth the Expense

It is indeed fitting that File 8 has Commissioner Day covering the topic of bonding and insurance for elected officials.  There is little recourse for citizens to deal with county commissioners whose actions may take a county in a direction counter to their best interests. The phrase “high crimes and misdemeanors” connoted serious offense in English law and was used by the framers of the Constitution at least partially as a description of behavior that while not always criminal under the law was still deserving of removal from office.

With the start of File 13 we as citizens watch the approach of that point. I don't throw that out there without cause, this commission is already the target of a legal case involving development.

Before getting to that point File 12 has a rather unusual 2-1 vote among the three amigos on the hiring of a Director of Land Use Management.  The commissioners voted 2 – 1 to hire Bob Brower for the job, no problem there. It is the line from point A to Point B that had me scratching my head as to what the under-current was in the room. If you have time listen to the interaction.  Bob accepts the job in file 14.

File 13 starts with Commissioner Wesler saying “Ok we are going to talk a little Goose Creek Crossing."  Commissioner Day replies “good” and proceeds to offer the most detailed pro and con explanation offered by a Preble County Commissioner to date on the Goose Creek issue. As posted previously there is not a lot of free money out there and Day covers that and more.  This file was transcribed completely to the best of my ability, read it, listen to it.

As a county we the people were told and sold the idea that the hiring of Shawnda Combs was for the purpose of promoting all of Preble County for economic development. That often stated position has proven popular as a means of support for the action. It is called into question by the statements of Commissioner Day not just once but twice. Having stated that minus Goose Creek there is no reason for or need for her. Now, I know that there are going to be claims that I have quoted him out of context but here are the quotes:

1:“Hey in 2013 at such and such we are going to have facilities up there and we can supply you water and sewer. Quite frankly until we get to that point, she has nothing to market.”

2:And if we don't move forward basically Shawnda we have no really need for Shawnda at that point because she has got nothing to market there.”

The entire statement that included those comments is transcribed below and the audio is there to be listened to. The point being that we as citizens have repeatedly been told that promotion of the “whole” county was the reason for the raising of the conveyance fee and her hire. This is the first clear and admitted indication that political fraud has been perpetrated on the citizens of Preble County over this issue.  Shawnda has been out around the county visiting elected officials, Chambers and businesses telling them she represents all of their interests but her feet were cut out from under her at this meeting.

 I’ll go out on a limb and say Preble County will not get the Job Ready Site money in this coming and last round of the program. There is less money than previously available and the competition will be that much tougher.

There are multiple reasons given to walk away from this proposed and coming large financial obligation being foisted upon the citizens of Preble County. I’ll refer readers to another quote from this meeting “I asked Shawnda about that a little bit, it's becoming during these times it's less an option for developers because there are plenty of spots out there. They don't need to develop. But if it is location and you get the right person wanting to locate there, we're still going to put dollars into it.”  

A truth worth repeating – “it's becoming during these times it's less an option for developers because there are plenty of spots out there. They don't need to develop.

It is not the first time though that truth was touched on in Preble County Commission chambers. I refer back to the often mentioned January 25, 2010, Commission meeting with Kevin Carver and Brewster Rhoads:

“When you’re running the numbers I think you have to be considerate of the long term gain into the community is. How you offset those upfront costs. The reason I ask you about land use is we are starting to see a lot of large logistics and distribution plays along I-70 in particular, much more so than I-75.”

If they are only $15 an hour jobs then people won’t want to travel 60 miles as gas prices are going to go back up.

2 hr.  39 minute mark   Rhoads or Carver asks how far away rail is. They are told 4 or 5 miles.That issue will come up. It won’t be a primary issue with every business you will run into, especially in the logistics and distribution field. There will be companies that have to have rail, some
might want to have rail and others it will all be over the road stuff. In the universe of logistics and distribution companies, you are going to shave off a piece because you do not have rail.

Let’s not forget the issue of high local school income taxes and these points:

3 hr.  11 minute mark   Just in last 3 years companies have moved or not located over an income tax. National Trail has a 1.75% income tax. Income taxes a non factor 20 years ago but now all points are being looked at. And moving over 2%.

Take some time and review the video of the February 7, 2011 meeting and you will hear Shawnda Combs mentioning Preble County for “Logistics and Distribution” and that Indiana can have the business component. Retail sales tax is the life blood of Preble County government, ceding it to Indiana is also worth a question or two.  Scroll the video over to the 15 minute 10 second mark and you will hear this:  “Indiana has an inventory tax, Ohio does not. My goal is to target the industries that Indiana is going after in regards to they can get the business component that can survive and flourish in Indiana just across the border here in Ohio in areas like this we could attract the “Logistics and Distribution” component because we don’t have an inventory tax here in Ohio.”  

If the focus is to be warehousing jobs then the people of Preble County should chime in on their thoughts as to the expense of Goose Creek being worth the cost. I don’t see it and my views are based on the statements put forth on the subject both in Preble County Commission Chambers and in the video provided.

Commissioner Day – good. The group met Thursday. I guess the biggest thing we need to decide. Shawnda has been marketing Goose Creek as a development site. Quite frankly if we don't try to get that to the point where it is classified as a job ready site nothing is going to happen there. No kidding and that is not going to happen.  I guess was kind of the general consensus of the group. Wouldn't you say Connie?

Connie – mmhh (affirmative)

Commissioner Day – Now, to get to that point we have to have the infrastructure there. Ahh Steve and Shawnda have looked at funding for the roads and that portion of it, the 127 and Orphan Rd. the intersection. There is not a lot of dollars out there right now. Steve actually even brought back that ODOT has told them there will be less dollars. Unless you have a commitment, you have once you get a site ready then there is dollars to if you are bringing jobs. The Governor has pledged to help with that so we've got to get the site ready. We can get the plans done and once we get some commitments then we can go back to the state and try to get funding through the Governor's office or Department of Development, ODOT, what have you.

Commissioner Stonecash – What do you mean by commitments? Somebody wanting to come in?

Commissioner Day – If you get what they're telling Shawnda and Steve said; If you got a commitment from a company saying "Hey I'm ready I'm, if your site is ready and will commit to that site and I'm bringing 200 jobs

Commissioner Stonecash – Ok that is what I thought you were

Commissioner Day – Then you can go to ODOT and thing and then they think that things could happen relatively quickly once you get that commitment but without it you're not going to get a lot of dollars at this point. That still doesn't mean that we, I think that we still need to pursue the JRS grant. Tweak the application ahhh I'm going to set up a meeting with Kleingers and find out you know ahhh get our deals from our closing meeting. Ahh find out what everybody's thought's are to tweak the application to get it ready, get it resubmitted and see if we can't pull those dollars down, from that.

Commissioner Wesler – Well when is the next round of the EDA ahh funding?

Commissioner Day – Ahhm don't know that there has been a date set. The last we heard there was no date set. Steve or Shawnda, either one didn't have a date. I think it's all going to be hinging upon some of these budget and what's coming out of that. I know those are Federal dollars but ahh they got some local ties to those also, obviously. So we will have to look at that one also. The ahh but I think that the general consensus is that we can go ahead and move forward trying to get the site ready so that this can be declared a Job Ready Site and kind of we will have to keep exploring options for the road and the intersection. The other part of that is the ahh water and sewer, which we know we've got, we've got the planning loans which will do the it's $484,390. I'll forward all of this to you guys. I mean you can write it down, I'll put all of this together. Ahh That will be the water and sewer planning. Ahh we need to pull the trigger and get started on the planning portion of this, if we are going to do this, that would turn Frank Leon and his group loose to start the design phase. The ahh other portion of that is we are going to have to be looking real seriously July 9th will be the one year on that land option. We will have a year to go that is another $472,000 I believe. Ahh I'll get the accurate, that's what Katie quoted, now I don't know if that included the down payment or not I don't remember what it was, I got to find out. The option. So between the two of those we are looking at ahh just under a million dollars. With the dollars that we need to say "yay or nay" and move forward.  If we ahhm the the once we commit to moving forward and start with the engineering phase then we can go to TA and Pilot and start talking to them about what their commitments are and thing of that nature. What they would commit to and start evaluating what real dollars we might bring in off of those. But until we commit to moving forward, I don't think we can really talk to them because we got a concept but we haven't committed to any further that our concept. Ahh worst case scenario if we did those two things there we would be looking ahh in about two two and a half years of having to start repaying for the ground and the engineering about $72,000 a year. The commitment we would have to make if we went no further. So that is just part of the equation here. Now, if we in a year from now if we pulled the trigger and about a year we would be ready to start construction bidding, bidding and construction at that point we are looking at about 6.2 (million) ahh total for the water and waste water. Ahh if we would do that we can continue in the interim pursuing the founding sources – grants, loans, things of the nature.  Ahhhh whatever options are out there. But if we pulled the trigger to do that we wouldn't have to make any payments until 2014, 2013 we would have the plants up and running and actually be able to tie customers on, start seeing revenues come in. Hopefully by then we've got something worked up between Pilot, TA and whomever else up there might be interested. You would immediately start seeing benefit from having a plant in place and see some revenues from that. An then there is the other side of that we may see some commitments from somebody if we can get it, if Shawnda can go out and say; Hey in 2013 at such and such we are going to have facilities up there and we can supply you water and sewer. Quite frankly until we get to that point, she has nothing to market. So, I guess the question here is; what additional information do you guys need to say let's move forward with the engineering? And then the second part of that is we need to start looking at what it is going to take to purchase the property. Ahh there's monies in this engineering, we can go back for additional monies for the purchase of property through OWDA, that avenue is there. Then that would all be rolled back into the construction loan and I've got to tweak my numbers, I've got chicken scratchings and I'll put all of that together for us but. We can put ahh we can roll that in, the engineering, the purchase of the property and then that can all be rolled into the construction loan which none of this the repayment plan starts until 2014. Ahhm which at that point in time ahhh and I haven't got the numbers crunched because I don't know what we would be expecting from Pilot or TA or anybody else that may be interested because ahhm they are all interested but until we get to the point of saying let's move forward and can give them some concrete answers, they are not going to set down at the table and say hey ahhm are you serious or aren't you? You know at this point we have talked to them a year ago and they haven't heard anything so. Ahhm I guess, in my mind, just me thinking, you know we made the commitment to get the option on the land, we pretty much made the commitment to move forward. And if we don't move forward basically Shawnda we have no really need for Shawnda at that point because she has got nothing to market there.

Commissioner Wesler – mmhhh (Affirmative)

Commissioner Day – And we need part of the discussion was, we need to see not only get this one ready but look at some of our other options that we've talked about and put those in the pipeline and try to get those job ready. Because one of the things everything that she said every time she talked you know the big boys that are looking for something, want a Job Ready Site that's what they are looking at to start with. Ahh before they are even going to get serious about a commitment. So that is kind of where we are at. Ahh you know we've got the money the money locked in for the water and waste water we can we can some up you know we've got time to work on some of these options but we can get the money to purchase the ground , worst case scenario, if we did all that we'd be lookin at about a $75,000 a year payback on those two things.

Commissioner Wesler – Well I'd like to see it like you said you're going to send it to us I'd like to see it down on your emails and then we can further discuss it maybe next week. But

Commissioner Day – What else or what other information do you need?

Commissioner Stonecash – When are you leaving?

Commissioner Day – Wednesday.

Commissioner Stonecash – So you will be gone

Commissioner Day – I won't be here next Monday. I'll be here Wednesday. I guess is there something else that, a part of this that, I guess me being involved in it is there something that I am not telling you or some information that you are not getting?

Commissioner Wesler – Well other than you know we were hinging heavily on the Job Ready Site Grant last time and ahh just we are talking lots of dollars here so I want make sure the different scenarios. That's why I'd like to see it down on your paper. Ahh by you emailing it to us but I don't think so at the moment. It is just staggering numbers here but I understand what the potential could be. How much has Frank been paid already from let's say Kleingers.

Commissioner Day – That I don't know, that was in that was in the contract with Kleingers, he is a sub with Kleingers, we have not paid him a dime.

Connie – We have not paid him anything.

Commissioner Day – We've got the agreements to execute and move forward and that's we need to make a decision if we are going to move forward. If not we just need to tell him you know; hey this is a no go. And like I said at that point we don't even really need Shawnda.

Commissioner Wesler – Have you ahh talked I mean at some point if I were in your shoes and throwing out these numbers I would maybe talk to the Dayton Development Coalition again and see if they have any other ahh anything that they can bring to the table to help with.

Commissioner Day – Well that's some option I mean, we'll as we move forward we can pursue all of those avenues. The problem is on this is until you say yes we are going to move forward some of these aren't open to you I mean it's kind of like Steve said up there; If you don't have a site that is Job Ready they don't really want to talk to you because it is still speculation.

Commissioner Stonecash – Well I think we've been told there are some companies that would like to locate there.

Commissioner Day – Right.  I mean unfortuantely it is the chicken or the egg game. You know ahhm yeah I can talk to the Dayton Development Coalition, we talked to them before and they said there are funds you know that you might be eligible for but until we make the commitment to say;"We're going to stick a shovel in the ground". Everyone is kind of hesitant.

Commissioner Wesler – Well will you be able to put that in detail for us to look over and have a chance to get that by Wednesday or

Commissioner Day – Yeah I'll get

Commissioner Wesler – Ok

Commissioner Day – I can forward this email from Frank. Ahh it's got timelines and then I'll put my notes on what I have put together so far. And you know the numbers are general, obviouslyy we won't know until it goes to bid what the construction costs would be.

Commissioner Day – And obviously once we get Frank and his staff on board ahhhm they're going to be chasing dollars for us also.

Commissioner Stonecash – We ought to be moving out of this recession before long.

Commissioner Day – And I can tell you that's kind of how these projects worked. You get into the design phase and then the engineers are working for you help you chase the dollars. I mean their the ones going to benefit the most out of it so. Well I would hope that the main priority was making sure Preble County benefited the most out of it.   They'll work on your behalf also.               

Commissioner Stonecash – Yeah is there such a thing as a there'd be a large developer that would come up here and spend some dollars?

Commissioner Day – If we, once we get to make a commitment. I mean you may see somebody come in and say hey I'll take this over, I'll there's always that possibility. I asked Shawnda about that a little bit it's becoming during these times it's less an option for developers because there are plenty of spots out there. They don't need to develop. But if it is location and you get the right person wanting to locate there, we're still going to put dollars into it. And some day pigs may fly but until then I suspect you will have to throw them off the roof to get them airborne. 

Commissioner Wesler – Well when we see it Wednesday we will ahh we will let you know. Is there anything else you can think of Connie?

Commissioner Wesler – I'd like to comment about we've been looking over this Director down the hallway there for quite a while. Something's have changed since we first started talking about that but we finally came to a consensus this afternoon that starting March 28 you will be the Director of that office. And ahh there is a few other things will ahh you know we also desire for you to be the Flood Plain Coordinator and possibly the Loss Control Coordinator and the BWC representative and we will give you time to get down there, assess what is needed in that office and come back and recommend to us what you would like to ahh how to you know continue take that office further down the road. So are there any questions you have?

Bob Brower – How much time are you thinking the 28 ??? (poor audio) to assess?

Commissioner Wesler – Oh I think we will give you time, we have some things to work out still with the Engineer as far as Tax Map because I guess he has been doing some of the GIS when there is requests. Ahhhm is it to where we the Engineer be flexible enough, if you think Chad needs to take a little bit of training in GIS, whether you need to there is a lot of things we need to talk over with ESRI who is the software people and ahh Connie will bring you up to date maybe tomorrow with ahh DDTI and how we're going to talk about a contract with them. Did I hear Mike called back a little while ago?

Connie – Yeah

Commissioner Wesler – So anyway thank you for coming in but we just thought we would let you know that right now. So

Commissioner Day – I guess the question is and you don't have to give an answer now, maybe you have already made your mind up. Do you want the position? Do you want to think about it?

Bob Brower – Ahh yeah I mean (poor audio) I've always tried to learn more. I saw a situation here where you know I felt —- possible I had a goal set and I feel like this is a step ahh in that direction. So yeah I was definitely interested and — having the opportunity and I appreciate the faith that you guys have —-

Commissioner Wesler – Well we voted ahhm to give you a raise ahhm to $19.10 an hour with a 90 day probation period and that would take you to $20.05. So
